RE: N.D.R.Ct. 8.5
The expiration date for N.D.R.Ct. 8.5, Domestic Relations Summary Proceedings, is October 1, 2001. As a result and at the request of Judge Bruce Bohlman, the Supreme Court has asked the Committee to review N.D.R.Ct. 8.5 and Judge Bohlman's request to make domestic relations summary proceedings available statewide. See meeting materials pages 103-124.
As you may recall, the Committee initially considered N.D.R.Ct. 8.5 as its September 28-29, 1995 meeting. A copy of the minutes of that meeting, as well as a Family Law Ad Hoc Committee Summary Report from which the rule evolved, are at pages 125-134 of the meeting materials for your review. Also included at pages 135-153 of the meeting materials are copies of the forms used by Judge Bohlman for domestic relations summary proceedings.
Proposed N.D.R.Ct. 8.5, on pages 154-157, makes the summary proceedings available statewide by deleting subdivision (h), and also amends the explanatory note to indicate the rule is adopted statewide.
