RE: Rule 6.1, N.D.R.Ct., Continuances
The Committee has received a referral from the Supreme Court, asking the Committee to review a rule change proposed by the Council of Presiding Judges and to make a recommendation to the Court. The proposed rule change would require courts granting continuances to conform to the docket currency standards contained in N.D. Sup. Ct. Admin. R. 12.
A proposed amended version of Rule 6.1 is attached, as are materials from the Presiding Judges. Staff has modified the language proposed by the Presiding Judges for the sake of clarity, but the Committee may wish to consider whether it prefers the language originally proposed by the Presiding Judges. Staff has also added an explanatory note to the rule.
