RE: Rule 49, N.D.R.Crim.P., Service and Filing of Papers
Attached are proposed amendments to Rule 49. The amendments are form and style amendments in the spirit of the December 2002 federal criminal rule amendments and are based on the amendments to Fed.R.Crim.P. 49.
Rule 49 contains some material not included in the federal rule. Revisions to this material are based on the federal court rule drafting guidelines and the North Dakota legislative drafting guidelines.
In anticipation of a time when documents that are not in paper form will be filed, the word "paper" in Rule 49 is changed to "document." This change has also been made in the other criminal rules where the word "paper" is used.
