RE: Rule 40, N.D.R.Civ.P, Assignment of Cases for Trial
The Note of Issue requirement previously contained in Rule 40 was eliminated effective March 1, 2008. A stray reference to this requirement was retained in the explanatory note. A rule draft eliminating this reference is attached.
The Committee may wish to take this opportunity to give the remaining language of the rule a look to make sure it is up-to-date and in accordance with current practice.
