RE: 1999 Annual Rules Package
By order dated November 17, 1999, the Supreme Court adopted the 1999 annual rules package, effective March 1, 2000. The only significant changes made by the court were to N.D.R.Ct. 6.11 and 11.1
Rule 6.11, "Predeliberation Discussion by Jurors," was amended as follows: "In a civil case, the court may, with consent of all parties without objection, allow the jury to engage in predeliberation discussion." The amendment changes the focus slightly by not placing the burden on the court to obtain consent. The parties are responsible for objecting.
Rule 11.1 was amended at the request of the State Bar Board. The change only allows nonresident attorneys not licenced in North Dakota to obtain permission to appear in a North Dakota state court proceeding. The State Bar Board wants attorneys living in North Dakota to obtain a North Dakota licence.
