RE: Rule 44, N.D.R.Crim.P.; Technical Change
At the last meeting, the Committee approved an amendment to N.D.R.Crim.P. 44 by a two-thirds vote. During the meeting, a number of motions were made in rapid succession amending the language.
As amended, the language does not read correctly. The language appears to require a subsequent proceeding to be maintained in the record under seal. Following is alternative language for the Committee's consideration.
Also, following is an amendment to N.D. Sup. Ct. Admin. R. 41, "Access to Judicial Records." The amendment notes the confidentially of ex parte applications for financial assistance in the appendix to Rule 41.
