RE: Rule 17.1, N.D.R.Crim.P., Omnibus Hearing and Pretrial Conference
Attached are proposed amendments to Rule 17.1. The amendments for the most part are form and style amendments in the spirit of the December 2002 federal criminal rule amendments.
Our Rule 17.1 includes provision for an omnibus hearing, something that is not part of the federal rule. The style revisions for the portion of the rule on omnibus hearings were done using the federal court rule drafting guidelines and the North Dakota legislative drafting guidelines; the revisions for the portion of the rule dealing with pretrial conferences (starting at line 47) were based more directly on the federal amendments.
The proposed changes are intended to be stylistic only.
