RE: N.D.R. Local Ct. P.R. § 10; Effective Term of Local Court Rules
The Supreme Court has requested Committee review of N.D.R. Local Ct. P.R. § 10. In particular, the Court is concerned about the effective term of local court rules. Section 10.1 provides: "Each Local Court Procedural Rule and Administrative Rule is effective for a period of 5 years unless otherwise ordered by the Presiding Judge."
Districts have had local rules which are no longer effective according to section 10.1. For instance, the Northwest Judicial District's case reassignment procedure expired July 1, 1997, and a new rule was not adopted until June 30, 1998.
Should Section 10 be amended?
