RE: N.D.R.Ct. 3.2 and N.D.R.Civ.P. 7; Briefs on Motions
Michael Sturdevant has submitted a letter to Justice Sandstrom, accompanied by May 8, 2000, and May 15, 2000, memoranda from Cathy Bacon to Judge Olson, discussing whether or not briefs must be filed on all motions, regardless of whether or not oral arguments are requested. Sturdevant has suggested the Committee consider a review of N.D.R.Ct. 3.2 at an appropriate future date.
As the Committee may recall, the Committee extensively considered N.D.R.Ct. 3.2 in 1996, and a similar issue about briefs was on the Committee's January 1996 agenda. These materials include the part of the materials about briefs from the January 1996 meeting, as well as the minutes regarding that material.
