RE: Rule 11.2, N.D.R.Ct., Withdrawal of Attorneys
In September 2004, the Committee approved an amendment to Rule 11.2 requested by the Supreme Court clerk. Rule 11.2, therefore, is part of the Annual/Criminal Rules Package now pending before the Court.
Attorney Lynn Boughey has submitted a request for an additional change to Rule 11.2. He would like to have the rule amended so that an attorney who has already received permission to withdraw from a matter can avoid having to serve the party with notice of withdrawal and the withdrawal motion.
The proposed amendment appears at lines 5-6 of the attached proposal. Mr. Boughey's letter requesting the amendment is also attached.
