Proposed Amendments to the North Dakota Rules of Civil Procedure, Rules of Criminal Procedure, Rules of Evidence, Rules of Court, and Supreme Court Administrative Rules

On July 9, 2004, the Joint Procedure Committee filed proposed amendments to N.D.R.Civ.P. 51 (Instructions to Jury) and 53 (Masters), N.D.R.Crim.P. 46 (Release from Custody), N.D.R.Ev. 608 (Evidence of Character and Conduct of Witness), N.D.R.Ct. 3.1 (Pleadings), 3.2 (Motions), 6.5 (Masters), and 8.10(Extraordinary Writs), and N.D. Sup. Ct. Admin. R. 20 (Magistrates) and 41(Access to Judicial Records). Subsequently, on September 9, 2004, the Joint Procedure Committee forwarded additional proposed amendments to N.D.R.Ct. 3.1. Notice was provided under Section 7, N.D.R.Proc.R., and a hearing was held on the proposed amendments on October 4, 2004, at 2:45 p.m. At that time, any written comments received were also submitted to the Court. The Court considered the matter,

ORDERED, proposed amendments to N.D.R.Civ.P. 51 and 53, N.D.R.Crim.P. 46, N.D.R.Ev. 608, N.D.R.Ct. 3.1, 3.2, 6.5, and 8.10, and N.D. Sup. Ct. Admin. R. 20 and 41, as further amended by the Court, are ADOPTED, effective March 1, 2005.
