Proposed Amendments to the North Dakota Rules of Professional
Conduct
On December 9, 2008, the Joint Committee on Attorney Standards forwarded
proposed
amendments to North Dakota Rules of Professional Conduct 1.0, Terms, and 1.15, Safekeeping
Property and Professional Liability Insurance Disclosure, which were proposed subject to
legislation. A Notice of Comment was distributed was published on the Supreme Court website
on
December 10, 2009. House Bill No. 1207 relating to an exemption to bank confidentiality
requirements for attorney trust account overdrafts and to the conduct of attorneys was signed by
the
Governor April 21, 2009. The Court considered the matter, and
ORDERED, the proposed amendments to N.D.R. Prof. Conduct 1.0, as further amended by the Court; and N.D.R. Prof. Conduct 1.15 are ADOPTED effective August 1, 2009.
The Supreme Court of the State of North Dakota convened April 29, 2009, with the Honorable Gerald W. VandeWalle, Chief Justice, and the Honorable Dale V. Sandstrom, the Honorable Mary Muehlen Maring, the Honorable Carol Ronning Kapsner, the Honorable Daniel J. Crothers, Justices, directing the Clerk of the Supreme Court to enter the above order.
