Kathleen did not forego any opportunities or lose advantages due to the marriage C. Kathleen does have a comparable earning ability D. Kathleen is not disabled E. One minor incident does not support a finding of domestic violence F. Kathleen's financial misconduct was ignored by the court G. Kathleen is capable of rehabilitation 2. The court erred by not considering the property division when determining the amount of spousal support 3. The court erred in not eliminating or reducing the award of spousal support upon Don's retirement Appellee's Statement of the Issues: The trial court properly awarded permanent spousal support to Kathleen Sommer. The trial court properly considered the property division when determining the amount of spousal support. The trial court did not err in continuing spousal support without a defined reduction upon Donald's retirement. Kathleen Sommer is entitled to an award of attorney fees for this appeal. | ||||||
