Appellant's Statement of the Issues:
I. The district court erred in entertaining the defendant's motion to suppress because the defendant failed to make a prima facie showing of any improper conduct by the trooper prior to the hearing.
II. The district court erred in granting the defendant's motion to suppress, when the defendant's own testimony at the suppression hearing provided a basis for a finding of a reasonable and articulable suspicion of a violation of a law or a request
for community caretaking assistance.
Appellee's Statement of the Issues:
ISSUE I. The District Court did not err in allowing the evidentiary hearing to go forward in absence of any requested continuance by the Plaintiff.
ISSUE II. The District Court did not err in granting Defendant's Motion to Suppress.
