Whether N.D.C.C. 65-02-11 permits Workforce Safety and Insurance ("WSI") to ask witnesses to review videotapes or other records in a deposition relating to a fraud investigation.
Appellee's Statement of the Issues:
I.Whether the District Court committed error by refusing to force Dr. Jayant Damle, M.D. and Brenda Hanson, PA-C to view videotape surveillance of the WSI claimant and be questioned by WSI as to the videotape's contents.
II.Whether the District Court committed error by allowing Dr. Damle and Ms. Hanson to be subpoenaed for deposition by WSI, without WSI first providing notice to the WSI claimant at issue.
