Larry A. Zabolotny appealed from a divorce judgement awarding custody of the parties' two minor children to Gena Zabolotny. The judgement is affirmed under N.D.R.App.P. 35.1(a)(2), (4).
Gena's motion for attorney fees in defending the judgement in this appeal in remanded to the trail court for determination based upon the parties' needs and abilities to pay attorney fees, the necessity for incurring them, and the reasonableness of the fees incurred.
