[¶1] Schmit Brothers Construction, Inc., has appealed from the judgment and from an order denying its motion for a new trial entered in an action by Scott and Debra Johnson to recover damages arising out of the construction of their home. The judgment and order are affirmed under N.D.R.App.P. 35.1(a)(4).
